شروط الاستخدام

بالوصول إلى immersaapp.com واستخدام أي من خدمات Immersa، فإنك توافق على الالتزام بهذه الشروط. إذا لم توافق، لا تستخدم المنصّة.

١. التعريفات

• "Immersa" / "نحن": الشركة القائمة في المملكة العربية السعودية ومشغّلة منصة immersaapp.com.
• "المستخدم" / "أنت": أيّ شخص طبيعي أو اعتباري يستخدم المنصّة.
• "المنصّة": موقع immersaapp.com، تطبيقات الويب، والخدمات المرتبطة (Done، Self، Developer).
• "المحتوى": الصور، الفيديو، الأوصاف، والبيانات التي يرفعها المستخدم أو نُنتجها نيابةً عنه.

٢. وصف الخدمات

تقدّم Immersa ثلاث فئات من الخدمات:

• Done (خدمة مُدارة): نُرسل فريق تصوير، نعالج الصور، ونسلّم جولة جاهزة.
• Self (SaaS): اشتراك شهري/سنوي لرفع ونشر الجولات باستخدام معدّات المستخدم.
• Developer (Enterprise): عقود مؤسسية مخصّصة بشروط منفصلة.

٣. الحساب

• يجب أن تكون ١٨ عاماً أو أكبر لإنشاء حساب.
• أنت مسؤول عن سرّية كلمة المرور وكافة الأنشطة التي تتم تحت حسابك.
• يجب تقديم بيانات صحيحة وكاملة. البيانات المُضلّلة قد تؤدي إلى إنهاء الحساب فوراً.
• حساب واحد لكل فرد/شركة. إنشاء حسابات متعدّدة للتحايل على حدود الخطة مخالف للشروط.

٤. الدفع والاشتراكات

• جميع الأسعار بالريال السعودي (SAR) وشاملة ضريبة القيمة المضافة ١٥٪.
• الدفع مقدّماً عبر بوابات الدفع المعتمدة (Moyasar، Stripe).
• خدمة Done: الدفع كامل عند الحجز. استرداد كامل قبل التصوير، لا استرداد بعد التصوير (نحوّل إلى رصيد).
• اشتراك Self الشهري: يُجدَّد تلقائياً. إلغاء في أي وقت من لوحة التحكم.
• اشتراك Self السنوي: خصم ٢٥٪. استرداد نسبي للأشهر غير المستخدمة.
• الفواتير تُصدر متوافقة مع ZATCA المرحلة الأولى (Fatoorah Generation). المرحلة الثانية (التكامل والتصديق الإلكتروني) تُفعَّل عند بلوغ الحدود الرسمية.
• حذف الحساب (PDPL): يمكنك طلب حذف حسابك من صفحة الإعدادات. يُجدول الحذف بعد فترة انتظار 14 يوماً يمكنك خلالها إلغاؤه بتسجيل الدخول. بعد انتهاء المدة تُحذف جولاتك ومشاريعك وبياناتك نهائياً. فواتير ZATCA الضريبية محفوظة ١٠ سنوات بحكم القانون. يمكنك أيضاً طلب نسخة من بياناتك (PDPL المادة 17) من نفس الصفحة.

٥. الاستخدام المقبول

يُحظر استخدام المنصّة في:

• نشر محتوى مخالف للأنظمة السعودية، الآداب العامة، أو حقوق الملكية الفكرية.
• محاولة اختراق النظام، عكس هندسة الكود، أو إساءة استخدام API.
• جمع بيانات المستخدمين الآخرين دون إذن صريح.
• إرسال Spam أو محتوى احتيالي.
• تجاوز حدود الخطة عبر وسائل تقنية.

الانتهاكات قد تؤدي إلى إيقاف فوري للحساب بدون استرداد.

٦. المحتوى والملكية

• المحتوى الذي ترفعه: أنت تبقى المالك الكامل. تمنح Immersa ترخيصاً محدوداً غير حصري لاستضافته وعرضه وفق تعليماتك.
• المحتوى الذي نُنتجه لك (خدمة Done): الصور الأصلية + الجولة الناتجة مُلكك بعد الدفع الكامل. نحتفظ بحق عرض عيّنات مجهولة الهوية في عروضنا التسويقية.
• الوصف المُولَّد بالذكاء الاصطناعي: أنت تملكه. نحن لا نستخدم محتواك لتدريب نماذج خارجية.
• علامة Immersa التجارية: "Immersa" والشعار مُلكنا. لا يجوز استخدامهما بدون إذن كتابي.

٧. إنهاء الخدمة

• يمكنك إلغاء حسابك في أي وقت من إعدادات الحساب. تبدأ فترة سماح ١٤ يوم يمكن خلالها التراجع وتصدير بياناتك.
• يحق لنا تعليق أو إنهاء حسابك فوراً عند: (أ) انتهاك الشروط، (ب) عدم الدفع، (ج) طلب رسمي من جهة حكومية.
• بعد انتهاء فترة السماح (١٤ يوم) تُحذف البيانات الشخصية بالكامل (مع cascade للجولات والوحدات والمشاهدات). الفواتير الضريبية تُحفظ ١٠ سنوات بموجب نظام ZATCA.

٨. حدود المسؤولية

الخدمة تُقدَّم "كما هي" بدون ضمانات صريحة أو ضمنية. Immersa لا تتحمّل المسؤولية عن:

• خسائر تجارية غير مباشرة (صفقات لم تُتمّم، عملاء فُقدوا).
• انقطاع الخدمة الناتج عن أعطال عند مزوّدي البنية التحتية (Fly.io، Cloudflare، إلخ).
• محتوى ينشره المستخدم وينتهك حقوق طرف ثالث.
• أضرار ناتجة عن اختراق تسبّب فيه المستخدم (كلمة مرور ضعيفة، تسريب لجهاز شخصي).

الحد الأقصى للمسؤولية الإجمالية: قيمة ما دفعه المستخدم لـ Immersa خلال الـ ١٢ شهر السابقة.

٩. مستوى الخدمة (SLA)

• الخطة المجانية: بدون ضمان رسمي. نسعى لـ uptime ٩٩٪ لكن لا نضمنه قانونياً.
• Pro: ٩٩٪ uptime مستهدف. تعويض على شكل رصيد إذا نقص الـ uptime عن ٩٨٪ في الشهر.
• Studio: ٩٩.٥٪ uptime. تعويض على شكل رصيد إذا نقص عن الحد، وفق جدول SLA.
• Enterprise: حسب العقد المخصّص (يبدأ من ٩٩.٩٪ uptime).

١٠. تعديل الشروط

نحتفظ بحق تعديل هذه الشروط. التعديلات الجوهرية نُخطر بها عبر البريد قبل ٣٠ يوم من السريان. استمرارك في استخدام المنصّة بعد تاريخ السريان يعني موافقتك على النسخة المحدّثة.

١١. القانون الحاكم وتسوية النزاعات

• تخضع هذه الشروط لأنظمة المملكة العربية السعودية.
• الاختصاص القضائي الحصري للمحاكم المختصة في مدينة الرياض.
• قبل اللجوء للمحاكم، نُشجّع التسوية الودية عبر مراسلة legal@immersaapp.com.
• للنزاعات التجارية B2B، يمكن اللجوء للتحكيم وفق أنظمة المركز السعودي للتحكيم التجاري (SCCA).

١٢. التواصل القانوني

Terms of Service

By accessing immersaapp.com and using any Immersa services, you agree to be bound by these Terms. If you do not agree, do not use the platform.

1. Definitions

• "Immersa" / "we": the Company registered in Saudi Arabia [pending registration].
• "User" / "you": any natural or legal person using the platform.
• "Platform": immersaapp.com, related web applications, and services (Done, Self, Developer).
• "Content": images, video, descriptions, and data uploaded by the user or produced on their behalf.

2. Services

• Done (managed service): we dispatch a photographer, process images, and deliver a ready tour.
• Self (SaaS): monthly/annual subscription for users to upload and publish tours with their own equipment.
• Developer (Enterprise): custom enterprise agreements under separate terms.

3. Account

• You must be 18 or older to create an account.
• You are responsible for the confidentiality of your password and all activity under your account.
• You must provide accurate and complete data. Misleading data may result in immediate termination.
• One account per individual/company. Creating multiple accounts to circumvent plan limits violates these Terms.

4. Payment and Subscriptions

• All prices in Saudi Riyal (SAR), inclusive of 15% VAT.
• Prepaid via approved payment gateways (Moyasar, Stripe).
• Done service: full payment at booking. Full refund before capture, no refund after (converted to credit).
• Self monthly: auto-renews. Cancel anytime from the dashboard.
• Self annual: 25% discount. Pro-rated refund for unused months.
• Invoices issued compliant with ZATCA Phase 1 (Fatoorah Generation). Phase 2 (Integration / Clearance) is activated when the regulatory revenue threshold is reached.
• Account deletion (PDPL): request deletion from the dashboard settings. A 14-day grace period is scheduled; log back in anytime during the window to cancel. After the grace ends, your tours, projects, and personal data are hard-deleted. ZATCA tax invoices are retained for 10 years by law. You may also request a copy of your data (PDPL Article 17) from the same page.

5. Acceptable Use

It is prohibited to use the platform to:

• Publish content violating Saudi regulations, public morals, or intellectual property rights.
• Attempt system intrusion, reverse engineering, or API abuse.
• Collect other users' data without explicit consent.
• Send spam or fraudulent content.
• Bypass plan limits through technical means.

Violations may result in immediate account suspension without refund.

6. Content and Ownership

• Content you upload: remains fully yours. You grant Immersa a limited, non-exclusive license to host and display it per your instructions.
• Content we produce (Done): originals + generated tour belong to you after full payment. We retain the right to display anonymized samples in our marketing.
• AI-generated descriptions: you own them. We do not use your content to train external models.
• Immersa trademark: "Immersa" and the logo are ours. Not to be used without written permission.

7. Termination

• You may cancel your account anytime from account settings. A 14-day grace period begins, during which you can cancel the deletion and export your data.
• We may suspend or terminate your account immediately for: (a) breach of Terms, (b) non-payment, (c) formal government request.
• After the 14-day grace ends, personal data is fully purged (with cascade to tours, units, view logs). ZATCA tax invoices are retained for 10 years as required by Saudi tax law.

8. Limitation of Liability

The service is provided "as-is" without express or implied warranties. Immersa is not liable for:

• Indirect commercial losses (lost deals, lost customers).
• Service interruptions caused by infrastructure providers (Fly.io, Cloudflare, etc.).
• User-published content infringing third-party rights.
• Damages from user-caused breaches (weak password, personal device leak).

Maximum aggregate liability: amount paid to Immersa in the preceding 12 months.

9. Service Level (SLA)

• Free / Pro: no SLA. We target 99% uptime but do not contractually guarantee it.
• Business: 99.5% uptime. Credit compensation if below threshold.
• Agency: 99.9% uptime. Higher compensation per contract schedule.
• Developer (Enterprise): per custom contract.

10. Changes to Terms

We reserve the right to modify these Terms. Material changes will be notified by email 30 days before effect. Continued use after effective date constitutes acceptance.

11. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the Kingdom of Saudi Arabia.
• Exclusive jurisdiction of competent courts in Riyadh.
• Before litigation, we encourage amicable settlement via legal@immersaapp.com.
• For B2B commercial disputes, arbitration under the Saudi Center for Commercial Arbitration (SCCA) is available.
